OpenlyCompared terms of use

These terms apply to anyone reading or using OpenlyCompared (openlycompared.com), the comparison website owned and published by Toutmark LLC. By using OpenlyCompared, you agree to them.

Who do these terms come from?

OpenlyCompared is a website owned and published by Toutmark LLC. In these terms, “we” and “us” mean Toutmark LLC, and “the site” means OpenlyCompared.

Does OpenlyCompared give advice?

No. OpenlyCompared publishes general information to help buyers compare businesses. Nothing on OpenlyCompared is legal, tax, financial or investment advice, and nothing on OpenlyCompared is an offer to buy or sell any security. OpenlyCompared's private credit directory is information for businesses seeking financing, and contains nothing about investing with any lender. Before you rely on anything on OpenlyCompared for a decision that matters, check it with the company and, where it helps, with a qualified professional.

How accurate are the facts on OpenlyCompared?

Facts on OpenlyCompared come from each company's own published information or from the company itself, and each fact shows its source and the date it was checked. A company can change its services, prices or details after that date, so a fact on OpenlyCompared can be out of date. OpenlyCompared corrects facts that are shown to be wrong; you can ask for a correction through the corrections form.

Does a listing on OpenlyCompared mean a company is endorsed?

No. A listing on OpenlyCompared, or a “Best for” label, is not an endorsement, a recommendation for your situation, or a guarantee of any company's work. Any agreement you make with a company listed on OpenlyCompared is between you and that company.

Yes. Some companies listed on OpenlyCompared pay Toutmark LLC for its services. OpenlyCompared marks each of them “Toutmark client” wherever they appear and marks links to their websites as sponsored. Paying never buys a position or a label. How we make money.

Who owns the company names and trademarks on OpenlyCompared?

Company names, logos and trademarks shown on OpenlyCompared belong to their owners. OpenlyCompared uses them only to identify the companies it describes, and their use does not mean the owner endorses OpenlyCompared or is connected with Toutmark LLC, unless the company is marked “Toutmark client”.

No. OpenlyCompared links to companies' own websites and to the sources of its facts. Toutmark LLC does not control those websites and is not responsible for their content, products or privacy practices.

Can I quote or reuse OpenlyCompared's content?

Yes, within limits. You may quote short passages from OpenlyCompared and link to any page, as long as you link to the page you quote and do not change its meaning. Search engines and AI assistants are welcome to read and cite OpenlyCompared. You may not republish whole pages, present OpenlyCompared's content as your own, or suggest that OpenlyCompared or Toutmark LLC endorses you.

What happens to what I send OpenlyCompared?

When you send OpenlyCompared a correction, a request or an email, you confirm that it is accurate to the best of your knowledge and that you are entitled to send it. OpenlyCompared uses it to check and correct the site and to reply to you, as the privacy policy explains, and does not publish your message.

If you believe something on OpenlyCompared infringes your copyright, email [email protected] with the page, the work you believe is infringed, and how to reach you. Toutmark LLC reviews every notice and removes material that infringes.

Does OpenlyCompared come with a warranty?

No. As far as the law allows, OpenlyCompared is provided “as is” and “as available”, without warranties of any kind, including warranties that its information is accurate, complete or current, or that the site will be available without interruption.

Is Toutmark LLC liable for decisions made from OpenlyCompared?

As far as the law allows, Toutmark LLC is not liable for any loss or damage arising from your use of OpenlyCompared or your reliance on its information, including indirect, incidental or consequential loss, and including any dealings you have with a company listed on OpenlyCompared. Some places do not allow these limits, so they may not all apply to you.

Can these terms change?

Yes. When these terms change, OpenlyCompared updates them here and changes the date at the top of the page. Questions about these terms go to [email protected].
